CONTRACT AGREEMENT
BETWEEN
Mr. Kajke Madhavaraya Kamath residing at Gandragolipura, Nelamangala 562123 Bangalore Rural dist
Karnataka. Here in after called the OWNER
AND
B.Yogesh Prabhu (M/s Alma Interiors). a company registered under the Companies Act, 1956 and having its
registered office residing at: #32,2nd Floor, Nayak Layout, J P Nagar 8th Phase, Bangalore – 560076, Here in
after called the DEVELOPER and CONTRACTOR.
For the construction of residential building of Mr. Kajke Madhavaraya Kamath Situated at #109, Rashi
Gateway, 3rd Phase, Nelamangala, Bangalore – 562 123 belongs to the owner.
The terms of this contract include all the documents listed below and constitute the entire terms of
the agreement between the owner and the Developer. The terms of this contract shall prevail over any
conflicting provision in the documents incorporated as reference.
1. Annexure 1: Schedule of Work.
2. Annexure 2: Materials Specification & Work Quotation.
The Complete development plans and drawings shall be prepared by Architect.
1. The contractor will construct the building as per architects drawings and specifications.
2. The contractor will use materials and workmanship of good quality and good standards as directed by
the architect and the owner as per the Contract agreement.
3. Safety gears required for laborer’s will be provided by contractor. Security and safety of the workers
at the construction site will be sole responsibility of the contractor. In case of any accident/death at
the construction site the owner will not be held responsible for it. The owner will not be responsible
for paying any compensation to the injured/deceased. Security of materials at construction site will be
provided by the contractor, any loss incurred due to theft will be borne by the contractor.
4. Contractor’s responsibility to make sure no damage is done to neighboring buildings during
construction, the repair works of any such damage to borne by the contractor.
5. Adequate water proofing will be done for water tank (sump) and terrace. The curing for the RCC
structures will be done by the contractor taking into consideration the appropriate number of days for
curing period.
6. Rates shall remain fixed during the entire construction of the house. This includes all duties, taxes,
levies etc.
7. In case any faults like cracks in walls, RCC columns, RCC roof, honeycomb formation in pillars,
dampness in walls, water seepage in walls or water tank occur within 1 year period then the
rectification of such faults will be done by the contractor at free of cost. The architect will be the
arbiter in deciding if the fault is severe enough to be rectified.
8. The contractor will notify the owner in writing mentioning the reason if there is any delay progress of
construction work.
9. The owner will transfer the payment amount towards construction to the account provided by the
contractor or cash against bills or whenever necessary.
10. If at any stage of work the owner desires to make any changes in terms of material selection or
construction, the owner shall provide it in writing to the contractor and the contractor shall execute
the same keeping in view the safety of the structure. The cost difference associated with such a
change will be borne by the owner.
11. The contractor shall be entitled for payment as per the schedule of work mentioned below. The
payment shall be made based on the actual measurements of work executed and completed. This will
be determined and certified by the architect and the owner.
12. The contractor must co-ordinate and co-operate with other agencies involved in other works on the
site such as electrical, plumbing and interior works.
13. The contractor or his authorized representative shall record the measurement and there after present
the bill to the architect for verification and assist the architect/ representative in checking and
verification of the bill.
14. The arrangement for the supply of water and electricity at site will be borne by the owner till project
completion. The recurring expenses towards the maintenance, safety of equipment etc., incurred
during construction period shall however be borne by the contractor.
15. “The developer and the contractor agree that if materials mentioned in annexure 2 are purchased
above or below the mentioned rates, the rate at which the materials are purchased will be considered.
The differential amount will be adjusted in the payment".
16. The contract shall be terminated if any one of the following occurs:
1. Construction is stopped beyond 30 days without any prior notice provided by the contractor to
the owner.
2. If contractor persistently neglects to comply with written notice from the architect or owner
requiring him to remove defective work or improper material or goods and by such refusal or
neglect that can materially affect the work.
We understand and agree to all the terms and conditions mentioned in the above agreement.

25. Terrace floor - Cement finish with 2’ x 2’ Groove & the area is painted with heat Resistant Paint (Asian Paint).

11. Gas Pipeline: From Gas bunk to Kitchen.
