They shall ensure, so far as is reasonably practicable, that the article is so designed
and constructed as to be safe and without risks to the health of the workers when
properly used.
• Section 11: Cleanliness
Every factory shall be kept clean and free from effluvia arising from
any drain, privy or other nuisance.
In every factory the following, namely, every moving part of a prime mover and
every flywheel connected to a prime mover whether the prime mover or flywheel
is in the engine house or not; the headrace and tailrace of every water-wheel and
water turbine; any part of a stock-bar which projects beyond the head stock of a
lathe; and unless they are in such position or of such construction as to be safe to
every person employed in the factory as they would be if they were securely
fenced, shall be securely fenced by safeguards of substantial construction which
[shall be constantly maintained and kept in position] while the parts of machinery
they are fencing are in motion or in use.
Section 22: Work on or near machinery in motion
• The Chief Inspector, or the Director General of Factory Advice Service and Labour Institutes,
or the Director General of Health Services, to the Government of India, or such other officer as
may be authorised in this behalf by the State Government or the Chief Inspector or the Director
General of Factory Advice Service and Labour Institutes or the Director General of Health
Services may, at any time during the normal working hours of a factory, or at any other time as
is found by him to be necessary, after giving notice in writing to the occupier or manager of the
factory or any other person who for the time being purports to be in charge of the factory,
undertake safety and occupational health surveys and such occupier or manager or other person
shall afford all facilities for such survey, including facilities for the examination and testing of
plant and machinery and collection of samples and other data relevant to the survey.
