Laura Prepon and Ben Foster's temporary custody deal includes restrictions on how much alcohol they are allowed to drink around their children, per new court documents.

The actors, both 44, split in September 2024 and are parents to two young children. 

The new custody deal, details of which were obtained by InTouch Weekly, requires them both to limit their drinking when with their kids, days after she accused him of having issues with alcohol.

The order reads: 'Neither party shall consume alcohol to the point of intoxication while around the minor children during his or her parenting time.

Further, they agreed that 'if either party has employment that requires him or her to travel out of state during his or her parenting time, then that party will provide reasonable notice to the other party.'

The former couple also agreed to restraining employees from 'speaking derogatorily about the other party to or in the presence of the minor children.'

Last month Orange Is The Black star Prepon claimed Foster had a 'longstanding history of alcohol abuse' as she responded to his request for a temporary custody schedule.

She asked that Foster be ordered not to drink 12 hours before or during time with the children and also alleged he often 'day drinks.'

Foster’s lawyer, Rose Palermo denied these claims, telling the NY Post: 'Laura Prepon’s filing is the definition of falsehood and a disturbing fiction. Her actions will continue to harm the children who have always been Ben’s first priority.' 

In November it was revealed the pair were divorcing after 6 years of marriage.

It was Ben who filed for divorce according to TMZ, as the site added that the actors are already living separately.

The site alleged that the two split 'a few months ago' and Laura, 44, is currently living in Tennessee while Ben calls Los Angeles home.

Ben cited 'irreconcilable differences' and listed September 9 as their separation date in the divorce papers. He asked the court to enforce their prenuptial agreement. 

It was also added that Laura has not been wearing her wedding ring; she was ring-free in a Halloween Instagram post.

Her last Instagram post with Ben was made in December 2022. 

Together they have two children: a daughter named Ella, who was born in August 2017, and a son who was born in February 2020.

The couple met as teens through mutual Danny Masterson then started dating in 2016. In August of 2017 they welcomed their daughter. They wed in June 2018. In February 2020 they welcomed a son.

Prepon was in a relationship with Christopher Masterson, Danny Masterson's brother, from 1999 to 2007. She later dated Scott Michael Foster for several years, but said in 2013 they had broken up. 

Foster was engaged to Robin Wright from 2013 to 2015.

He has been in relationships with Karen Elson (2016), Jenna Danneberger (2011), Zoë Kravitz (2007 - 2008), Kirsten Dunst (2000 - 2001) and Antje Traue.

In 2021, Prepon said she was focusing on her 'own individual spirituality' after leaving Scientology.

The Orange Is the New Black alum joined the controversial religion in 1999, but revealed she chose to leave the faith around eight years ago.

Laura felt 'relieved' to have put Scientology behind her, a source said.

An insider said: 'She feels relieved to be living life on her own terms. She wants to focus on her own individual spirituality.'

Laura initially joined the religion to help her gain control of her emotions, but since marrying Foster and having two children she wanted to focus on her family life.

The source added to Us Weekly magazine: 'She's a mom now and she's moved on, and she is building her life around that. Laura found her own spiritual path and no longer wants to be associated with the church.'

Laura revealed she had cut ties with Scientology in an interview given in 2021, in which she said the religion is 'no longer part' of her life.

She said: 'I'm no longer practicing Scientology. I've always been very open-minded, even since I was a child.

'I was raised Catholic and Jewish. I've prayed in churches, meditated in temples. I've studied Chinese meridian theory. I haven't practiced Scientology in close to five years and it's no longer part of my life.'

The That '70s Show star said that she and Ben – who has never practiced the religion – put their energy into meditation to help keep them centred rather than any particular religion.

She added: 'We meditate daily and I'm really liking it because it's something that helps me to hear my own voice and it's something we can do together.'

Also in 2021, Laura said that she  was 'riddled with anxiety' when she became a mother.

She battled with anxiety when her daughter was born because she wasn't sure she had what it takes to be a mother.

She said: 'If motherhood has taught me anything so far, it's that something can work out for a period of time and then you move on and evolve from that.

'As a new mom, I was riddled with anxiety that I had never experienced before. My friends who were mothers with older kids said, 'Laura, this is a phase, you'll move on and then it will be something different.' And that has transcended into other parts of my life. We're all evolving. I always see that with my kids.'

The star revealed her two children are growing up all the time and are 'changing every day'.

She added: 'They are changing every day now. My daughter is outgoing and wonderful and obsessed with mermaids — it used to be unicorns. She's also very determined and does not give up. My son is beginning to socialize with kids more in small classes. He's much more calm and observant.'

And Laura can't believe how much she loves her children, as she says having kids has filled her with an 'overwhelming sense of love'.

She told People magazine: 'When I had my second child I thought, how am I ever going to love a child as much as I love my first? Then you do and it's this overwhelming sense of love. It's incredible how that happens.'
