SUBJECT: SIGNIFICANT LOGISTICAL CONCERNS OF BFP-NCR

1. References:
a.) Republic Act 9184 and its RIRR: Government Procurement
Reform Act;
b.) National Budget Circular No. 425 dated Jan. 20, 1992: Manual
on the Disposal of Government Property;
c.) P.D. 1445: Audit Code of the Philippines; and
d.) Republic Act 4136: Land Transportation and Traffic Code.

2. Laws and policies guide government agencies in managing its properties.


Specific laws and issuances are also in place to standardize certain aspects of property
management across the bureaucracy. But even with the presence of these policies,
laws and guidelines, implementation still differ among agencies of the government
depending on their size and structure among others.

3. First concern, pertains to the prolonged problem of undocumented fire trucks


received by BFP-NCR (Bureau of Fire Protection-National Capital Region). To be
specific the Anos fire trucks and newly-turned over Rosenbauer.

4. Conventionally, the BFP-NCR merely serves as a recipient/end-user when it


comes to Fire Trucks procured by the bigger entity, the “BFP”. Thru the process of
issuance, we became the lucky recipient of the afore-mentioned fire trucks.

5. As defined by the rules on property management issuance is the act of


transferring the custodianship of a property from one person to another. Hence, the
BFP-NCR merely holds a Property Acknowledgement Receipt as proof of receipt. When
the BFP-NCR inquired about the documentary requirements as to ownership, the same
were not available due to controversial issues surrounding the acquisition of the same.

6. Diligently, the BFP-NCR tried its best to register the undocumented fire trucks
but it was rejected by the Land Transportation Office for lack of proper requirements.
Hence, the BFP-NCR did not obtain any Certificate of Registration, Official Receipt and
Plate Number for the fire trucks.

7. Since the beneficial use of the fire trucks has been granted to the BFP-NCR, it
immediately run operational in order to serve its public purpose of responding to fire
calls. Statistically, numerous fire incident occurs in NCR. As a result of wear and tear
the fire trucks suffered some defects. The need for repair now arises. In order to meet
the emergency exigency of service and to continue the regular performance of duties,
the BFP-NCR deemed it wise to subject it for repair.
8. Second concern is about BER or Beyond Economic Repair fire trucks. History
revealed that no documentary requirements were succeeded by the current logistics
staff. The rule on the lifetime in the storage of paper documents maybe considered as a
factor for its non-availability. Also, we would like to inquire in your office if there are still
available records of BER fire trucks.

9. Be that as it may, the BFP itself as the procuring entity which acquired the
above-mentioned fire trucks may have stored in their records any proof of ownership.

10. In this regard, we would like to raise these significant logistical issues in your
office for proper documentation and to seek assistance in the registration of the
undocumented fire trucks.
