Assessment 1 – Written or Oral Questions


1. What WHS legislation applies to your workplace? Please include in your
answer:
The WHS legislation that applies to my workplace is the Work Health
and Safety Act 2011 (NSW) and its purpose is to provide a balanced
and nationally consistent framework to secure the health and safety
of workers and workplaces. This Act also describes the general
requirements for health, safety and welfare that needs to be met by
all working places in Australia.
a. Commonwealth WHS Acts
The principal WHS act in the Commonwealth jurisdiction consists of
the Work Health and Safety Act 2011, supported by the Work
Health and Safety Regulations 2011. The purpose of these Acts is to
require employers and other workplace members to consult and
cooperate in the management of workplace risks, in order to
protect the health and safety of workers and others who might be
at risk.
b. Regulations
The regulation that applies to my workplace is the Work Health
and Safety Regulation 2017 NSW. It regulates and ensures the
health and safety of workers and workplaces by protecting
workers and other people against any harm by reducing and
eliminating possible risks.
c. Codes of practice
WHS Code of Practice NSW is a practical guide to achieve the
standards of health, safety and welfare required by the WHS Act
2011. These codes of practice include:
- Work, health and safety consultation, cooperation and
coordination.
- First Aid in the workplace
- How to manage work, health and safety risk
- Managing the work environment and facilities.
d. Legislative and regulatory requirements for managing hazards
The Work Health and Safety Act 2011 and the Work Health and
Safety Regulation 2017 impose and state the specific people who
have the duty of care within and organisation. These Acts also
implement a hazard management process for workplace risk,
which include: identifying hazards, assessing risk and managing
decisions on how to effectively eliminate them. Managing
hazards could also be done through consultation. These
consultation arrangements must be established with the
workplace representatives; who are in charge of investigating
health and safety matters in the workplace and providing
trainings to induce the staff with the information.
e. Legislative and regulatory requirements for maintenance of records
WHS records and reports should be maintained for legal reasons, as

well as for establishing training needs. The data collected from the
reports allows the workers of an organisation to determine the
circumstances in which the incidents and hazards occur. This
information provides the data required to take the corrective actions
against them by improving or changing the company’s policies and
procedures. The data also gives the information necessary to give
training to the team members. These records should be considered
confidential because they may be used in legal actions.
2. How are these policies and other WHS information communicated?
The policies and other WHS information is communicated in
meetings in which the Work Health and Safety Acts, Regulations
and Codes of Practice are discussed in detail in order to ensure the
understanding of all the team members. The policies can also be
found on the Work Health and Safety official website, which has
information and access to legislations, regulations, and codes of
practice. Additionally, it can be found in the organisation’s policy
and procedures which is given to employees in their induction
process.
3. a. Who is responsible for ensuring that WHS policies are adhered to in your
workplace?
Duty holders and WHS managers of the organisation are
responsible for ensuring that Work Health and Safety policies are
adhered to my workplace. They do not only responsible for this,
but also for all the other Work Health and Safety responsibilities
for all the workplace personnel. These responsibilities may include
providing a safe workplace and safe systems of work. Also,
establishing and implementing WHS policies, procedures and
practices and ensuring that these are followed by the
organisation.
b. What are the responsibilities of this person?
The responsibilities are:
- providing a safe workplace and systems of work
- developing, establishing and implementing WHS policies,
procedures and practices
- ensuring that WHS procedures and standards are
followed
- consulting with employees and cooperating with WHS
representatives or committees
- Identifying hazards and ensuring that employees are
fully informed of them
- Being aware of relevant legislations
- Arranging regular inspections
- Developing and undertaking a preventive maintenance
program
- Arranging inductions and trainings on a regular basis
- Taking all necessary follow-up actions

4. a. What financial resources are required to manage WHS?


The Workplace Health and Safety NSW require financial resources
to cover the physical elements of Workplace Safety. These may
include:
- Clothing
- Safe and protective equipment
- First aid equipment
- Floor stand signs
- Warning signs

b. What human resources are required to manage WHS?


Duty holders, WHS managers, the management of the organisation
and the team members of the organisation are the human
resources required to manage WHS. Therefore, all members of the
organisation must receive relevant training in order to manage
Work, Health and Safety legislations, regulations and requirements
at all times. Work, Health and Safety legislations may be managed
through a Work Health and Safety Management System; which
consists of a formal, documented set of plans, responsibilities,
practices, actions, procedures and resources to be applied on the
workplace in regards of WHS.
5. How does your workplace ensure participation in the WHS process?
It’s possible to ensure workplace participation in the Work, Health
and Safety process through consultation. Throughout this process, all
employers can become aware of hazards and WHS issues
experienced by employees of the organisation. Workers can also
provide suggestions about how to solve health and safety problems,
when needed. Employee participation enables the employee to
contribute in determining how the work can be done in a safe way.
6. How are WHS issues resolved in your workplace?
In my workplace, WHS issues are first resolved by having the team
members meet with the relevant management. They communicate
with each other to help find a solution for it. In this meeting, it’s
important to consider factors like: how immediate is the risk, the
number and location of workers affected by it, what measures will
be implemented, and who will be responsible to do them.
These procedures look to eliminate the issues in a most suitable
way, with resolutions that might include changing or improving the
equipment in the workplace, or providing safe working methods and
practices. It is important for all of us in the workplace to know the
WHS policy and follow it in order to avoid issues.
7. How does your workplace report WHS issues:

a. in-house
Whenever a worker in the organisation identifies a WHS issue in
the workplace, he/she must notify the management about it and
complete all the appropriate reports or documents in order to
address the issue as soon as possible.
b. According to WHS reporting requirements?
All employees should be aware of WHS Act and regulations.
Therefore, all legislative requirements must be identifies. In
order to comply with the WHS reporting requirements, the
confidentiality of WHS records and reports should be maintained
for legal reasons. Whenever an incident occurs, the issue must
be reported to the WHS committee and a Work, Health and
Safety representative must be appointed as soon as possible.
The representative will review safety issues, and then
recommend actions to take.
